A MAN has been spared a driving ban despite admitting using a mobile phone while behind the wheel, as well as not having proper control of his vehicle.
Barry John Donnelly, 35, was spared disqualification under totting up procedures by Welshpool Magistrates’ Court last month due to several personal factors.
Magistrates sitting on Tuesday, August 13, were told he could lose his job as a director of a company.
They also heard the family farm could be at risk, while his mother’s deteriorating health was also a factor.
The offences date back to September 21, 2022, when Donnelly was driving a Toyota Land Cruiser on the A483 at Welshpool.

Appearing at court on August 13, Donnelly, of Scallen Road, Trillick, Omagh, County Tyrone, in Northern Ireland, pleaded guilty to driving while using a mobile, driving while not having proper control of the vehicle and driving with a registration mark that failed to conform with regulations.
Magistrates fined Donnelly £176 and told him to pay £90 costs and a £30 surcharge. They also endorsed his driving licence with six points.
Magistrates said there were mitigating circumstances, namely: “The loss of your employment as a director of a company and the impact on your employees and sub-contractors, you may lose the family farm; the impact on your brother and your brothers family; the impact on your mother and her deteriorating health.”
