A FATHER who has had his conviction for drink driving quashed on appeal to the crown court.
Daryl Lay, 46, had initially denied driving a BMW on the A458 at Buttington, near Welshpool, while over the legal limit on May 14, 2022.
The case was set down for trial but the defendant was convicted in his absence after he had missed the trial due to a pre-booked holiday.
Lay denied drink driving at an initial 2022 hearing at Welshpool Magistrates’ Court.
Lay, of Northbrook Road, Solihull, said he didn’t feel he had a fair trial as he was unable to attend.
He appealed the conviction and the appeal was allowed by Mold Crown Court on December 15, 2023.
