A Newtown woman will face a crown court judge who will decide whether or not she punched a pregnant woman in the stomach and told her "I'm going to kill your baby".

Carla Jane Dayas, 28, had already pleaded guilty in court to three counts of assault – causing actual bodily harm to her neighbour, and assaulting her neighbour's partner and another neighbour.

She was set to be sentenced today (Monday, December 19) at Mold Crown Court for crimes that happened during an attack at 2am on October 9.

However, Her Honour Judge Nicola Saffman said a Newton hearing – to determine the factual basis of her guilty pleas – should be held before the final sentencing hearing.

A Newton hearing is held when a defendant who has pleaded guilty but offers a substantially different version of events to those as told by the prosecution. Dayas denies striking her pregnant neighbour in the stomach and threatening to kill her unborn baby.

Judge Saffman said: "A Newton hearing is a finding of fact hearing into whether you punched [the victim] in the stomach or you said I’m going to kill your baby or words to that affect. It will make a material difference to your sentence whether or not those things happened or not."

Mold Crown Court will hear evidence on February 16 2023 so it can be decided which version is accepted as forming the basis for Dayas' sentence.

Dayas, of Heol y Coleg, Newtown, was given conditional bail not to contact the victims or loiter outside the home of the pregnant woman.
