A POWYS man who assaulted his grandfather after he was asked to turn the volume down on the TV has been jailed.
David John, was sent to prison last week for more than two years for offences of burglary and affray, and has now received an additional custodial sentence from magistrates in Welshpool on Tuesday, May 17.
John, 37, became verbally abusive towards Kenneth Park at the home they share in Newtown on September 25 last year, before pushing him up against a wall and grabbing him by the throat, causing a small cut to his face.
John, of Dinas, Newtown, had admitted assaulting Mr Park at a previous hearing. His original sentencing had been adjourned due to an impending hearing in the crown court related to the burglary and affray charges – John received a 28-month prison sentence on May 13.
Prosecutor Helen Tench said the assault occurred at around 10.30pm on September 25.
“The defendant and his victim, his grandfather, were at their joint home address,” she said.
“The victim asked the defendant to turn the volume down on the TV. The defendant overreacted and became verbally abusive. He pushed the victim up against the wall and held him by the throat.

“He was wound up but calmed down after about 45 minutes. He then went to his mum’s address, but then became abusive to her, which is when police were called.
“The defendant and his victim had ran off into Newtown town centre. The victim told officers he had been assaulted, suffering a small cut.
“In interview the defendant admitted grabbing his grandfather by the neck. His grandfather has not been supportive of the prosecution.”
Representing John, who appeared at the hearing via videolink from prison, Paul Inns said his client had been fully cooperative with the police.
“Drink played its part,” said Mr Inns.
“He was struggling with stress at the time, due to the ongoing crown court proceedings. There are other relevant matters too. His grandfather is the complainant, he is not supportive of the prosecution case and has been in court previously to support him.
“The injuries he sustained were limited and this offence pre-dates the suspended sentence so he is not in breach of it.
“The defendant is a complex individual. He has suffered trauma from childhood issues. He has shown deep remorse for this offence because his grandparents have given everything to him, including a loving home.”
In addition to being jailed last week, the crown court also made a compensation order of £1,488, which John has to pay.
Magistrates on Tuesday handed John an additional 12-week prison term – but they ordered it to be served concurrently.
No costs or compensation was ordered but John will have to pay a £128 surcharge.
